1. Agreement to Terms

By accessing or using BirthPath ("Service"), operated by BEBEKGENIUS LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

BirthPath is a practice management software designed for doulas and birth professionals. The Service provides tools for client management, appointment scheduling, document storage, mileage tracking, and related business operations.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

4. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe upon the rights of others
Transmit any malicious code, viruses, or harmful data
Attempt to gain unauthorized access to any portion of the Service
Interfere with or disrupt the integrity or performance of the Service
Collect or harvest any information from the Service without authorization

5. Data and Content

You retain all rights to the data and content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

You are solely responsible for ensuring that your use of the Service complies with applicable privacy laws and regulations, including obtaining necessary consents from your clients before storing their personal information in the Service.

6. Healthcare Disclaimer

BirthPath is a practice management tool and does not provide medical advice, diagnosis, or treatment. The Service is not intended to replace professional medical judgment. Users are responsible for ensuring their practices comply with all applicable healthcare laws and professional standards.

7. Subscription and Payment

7.1 Billing

Some features of the Service may require a paid subscription. By subscribing to a paid plan, you agree to pay all applicable fees. Subscription fees are billed in advance on a monthly or annual basis depending on the plan you select.

You authorize us to charge your chosen payment method for all fees. You are responsible for maintaining valid payment information. If payment fails, we may suspend or terminate your access to paid features.

7.2 Free Trial

We offer a 14-day free trial period for new users. During the trial period, you have full access to paid features at no charge and no credit card is required. When the trial ends, you will need to subscribe to a paid plan to continue accessing paid features. Your account will not be automatically charged.

7.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at support@bebekgenius.com. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of that period.

7.4 Refund Policy

We offer a 30-day money-back guarantee on all subscription plans. If you are not satisfied with the Service for any reason, you may request a full refund within 30 days of your initial purchase or renewal.

To request a refund, contact us at support@bebekgenius.com within 30 days of the charge. Refunds will be processed to the original payment method within 5-10 business days.

If you cancel your subscription after the 30-day refund period, you will not be charged for subsequent billing periods, but you will not receive a refund for the current billing period. Your subscription will remain active until the end of the current billing period.

7.5 Price Changes

We reserve the right to modify our pricing with 30 days' notice. Existing subscribers will be notified via email and will have the option to cancel before the new pricing takes effect. Continued use of the Service after price changes constitutes acceptance of the new pricing.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

The offline functionality of BirthPath allows continued access to certain features without an internet connection. Data created offline will sync when connectivity is restored.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by BEBEKGENIUS LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us. Upon termination, we will provide a reasonable period to export your data.

11. Limitation of Liability

To the maximum extent permitted by law, BEBEKGENIUS LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of the Service.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
